Is It Legal For A Prosecutor or a Defense Attorney to Divulge Points of a Case to the Public?

Is it Legal for Anyone to give away details or anything about a case to the general public, before a case. For example, a man is accused of Larceny by Employee, is it okay for the prosecution or the Defense Attorneys to give out specific information such as evidence or things said to the public?Is It Legal For A Prosecutor or a Defense Attorney to Divulge Points of a Case to the Public?
Criminal trials and their proceedings are a matter of public record. As such, there is no law prohibiting the prosecutor from revealing details about a case or information that he believes to be true prior to holding the actual trial. An exception would be either a case involving a minor, or a case wherein the judge has issued a gag order.Is It Legal For A Prosecutor or a Defense Attorney to Divulge Points of a Case to the Public?
Probably not a question of legality, more of a question of legal ethics, or procedure before trial.





It's done a lot, and may be in bad form, or may be a good thing for a case with high public interest, but that's how things are done.





Is it legal for the news media to publish or report stories that are false? That too is done a lot, and while it may be a bad idea, the gullible public tends to believe poorly developed reports if they coincide with their preconceived ideas of what is right. Most of the anti-Bush stories fall into this catetory, as do the Anti-Palin stories. They meet the needs of some, whether or not they are true.
Unless the judge has issued a gag order, either side can talk to anyone who will listen.
