What state are you in? What do you mean by charges? If it's a criminal case and your friend cannot afford an attorney, one will be appointed for him (public defender).

    Well, yes, it is just a paid witness.     Nah! They are just saying that they will pay your expenses, airfare, lost wages or whatever it costs you to attend. If you were an expert witness, they could pay you also. If they subpoena you, they will have to pay your expenses. But if they are offering to bribe you, that is illegal and I'll bet they never try.
    depends on what they mean by 'compinsate' they are either allowed, or required to repay any expenses you incur as a result of you making yourself available to testify. (rooms, airfare, transportation) or any wages you might lose during the time that you are required to be available to the court. anything other than that is bribery or witness tampering and probably a couple of other felonies that I can't remember the names for right now.
    If they are paying you to appear and tell the truth, then it's legal, but the fact that you are being paid might be considered to be germane to your testimony. (Meaning that the jury can consider the fact that you were paid to be there when they weigh your testimony, should that fact that you are being paid to appear be disclosed in court.)





    If they are paying you to give false testimony, then they are guilty of obstruction of justice even if you refuse their offer. (And you would be guilty of conspiracy if you accepted, and also guilty of perjury if you went through with it and testified falsely.) Although, in a civil case, it's possible that a summary judgment would be issued against them for doing so rather than referring charges for criminal prosecution.
    If they offered to pay you for giving evidence, this constitutes the very serious crime of conspiracy to pervert the course of justice. Of course you must report the matter. Make sure you have evidence, though, in case they claim that you asked them for compensation. These people sound nasty.


    Make sure too that they weren't simply saying that they would pay your expenses. This would be permitted by law.
    Unless you are being asked to commit PERJURY and lie under oath, it is not illegal to compensate you for testifying. Doctors are paid to testify in civil court cases every day. If however you are ASKED by the other attorney if you're being compensated for testifying, you have to admit that you are or else you are committing perjury and could go to jail for it.
    It's not a bribe unless they offer to pay you to testify falsely.

    You don't have any choice, by the way, in whether you will testify or not. If you refuse to testify voluntarily, they can subpoena you, and you must attend. If you refuse to answer questions you can be charged with contempt of court, and if you lie, you can be charged with perjury.

    In many states, if not all, witnesses who are subpoenaed to testify in court are paid a witness and mileage fee to appear. This is legal, as it is required by state law. Where I live, the witness fee is $20.00, and you are paid $0.20 per mile round trip.





    It's possible that this company was simply trying to entice you to testify by saying that they would paid for you to come there, when in reality they are required to do so. Deceptive, perhaps, but not illegal.

    1. For the time off from work because the plant is closed - No, not at all. They are only required to pay you for the time you work.

    Disabling conditions, including those requiring the use of prescriptions meds, are protected under the Americans with Diabilities Act (ADA.) However, ADA only requires an employer to treat disabled individuals the same way that they treat non-disabled individuals. It does not require an employer to substantially change a policy in order to hire, promote, transfer, etc., an ADA-eligible individual.





    Ask for a copy of their drug testing policy. If this employer has a policy that prohibits diving instructors from using any sort of drug (including Rx) that could impair mood, judgment, etc., then they are within their right to refuse to hire you. If they do NOT have a policy, and simply made a judgment call based on the test results, you may have grounds for a case.





    Because the employer does not mandate drug testing itself, and simply reviewed the results of a state-mandated test, they have in effect used your personal health information to make an employment decision. If their requirement for this job does not include a bona-fide occupational qualification with respect to the use of controlled substances, they are asking for trouble.

Most contingency-fee plaintiff's lawyers will provide you with a free (confidential) consultation.

    You don't have a case. All your employer-that-was has to say is ';We didn't hire him because we're concerned that he may forget to take his medication one day and what he might do if he did forget or missed his meds'; and the judge will buy it. You're talking about a job where you would be responsible for the safety of yourself and others, and an employer is clearly within their right to deny you employment for a condition that puts a client's safety at risk, even though your doctor said your condition doesn't affect your ability to perform your daily duties. They don't want to take the chance, and legally they don't have to.

    The girl can sue you for child support. That's about it. Unless she's a minor and you're not. Then they can get you for statutory rape. If you're from another country they have different customs and as a citizen of that country I would think you would know whats going to happen to you.

    You dont have to get married just because you got someone pregnant. But you need to take responsibility for your actions and that baby. If they do file a a law suit it will probably be for child support. If the baby is in fact yours you'll most likely be ordered to pay it.
    Probably nothing, you are not legally obligated to marry a girl because you get her pregnant. You can get taken to court for child support if you are indeed the father, however.
    If you didn't want a kid, then you should've kept your pants on. There's no way (legal or not) that you can be forced into marriage just because she's pregnant. But they can take you to court for child support/custody when the child is born.

    Probably depends on the company...If they say a weight limit or have some computer that shows when it's overloaded, then whoever last got on is responsible. I would think that they would be the first ones to be sued (if someone got hurt for example), and then they would file their own suits against other parties if there were other parties to blame.     You should talk to an attorney who specializes in medical malpractice. Some states allow wrongful pregnancy or wrongful birth claims, some do not. Your attorney will be able to give you a better idea of what remedies, if any, you might have.

    First there is an Arainment. All you do is go to court and tell then weather you plan to hire an attorney or if you need a court appointed attorney.





    Word to the wise: Court Appointed attorneys suck. Find a good attorney that will not settle for a plea bargin. Go for the win in General District Court. If you loose there appeal it and get a jury trial in Circuit Court.





    Then after the arainment they give you a court date. Find a lawywer before your court date and tell them the entire story. Dont leave out any details. There might be a loop hole. You must pay the lawyer in full before he will appear in court for you. If it is a lot of money set up a payment plan with them so that they can notify the court that they are representing you. The Lawyer will continue out the case until they are fully paid.





    Then you go to trial and you will get up on the stand and tell your side of the story. And the other side gets to tell their side of the story. Make sure you bring pictures, or anything else that will support your defense.

    Depends on what they said to you ... a verbal offer is still a legally-binding offer once you have accepted it.





    Offers are usually only provisional on things like satisfactory references, criminal records checks or proof of qualifications (yours, not someone else's!)

But here in Florida, if you know who the father is, then you have to have him served with papers that you are seeking custody of the two children. It doesn't matter if they were married or not, you have to find the father and have him served too.
    I think it would be safe for the children to get custody I don't know what the situation is. But it should be written by the judge who the children should reside with and when visitation days and hours between a mediator or whatever their called. It's just safe for the children. I remember my son was taken my his father and I got so scared because the judge ordered him to stay with my son at his mothers house. And he took off to his house far and I didn't have a car to go and get him. When I called the police they couldn't do nothing because I didn't have proof of the court order.

    Of course that's legal. The only rule is against the prosecutor speaking directly to the accused without his/her attorney present.     If you are concerned that the legal secretary is some kind of spy for the other lawyer I wouldn't worry about it too much. As long as your lawyer is aware that the legal secretary used to work for the opposing lawyer he or she can take reasonable steps to ensure there is no violation of client confidentiality.





    Additionally if the secretary and her the opposing lawyer were to conspire in such a manner it would constitute a violation of the law as well as ethics guidelines for lawyers which would result in mistrial, expose both of them to fines and criminal prosecution, civil claims by you and your lawyer, and disbarment for the opposing lawyer.





    There is nothing illegal in and of itself about legal support staff moving from one lawyer as an employer to another. If support staff moves from one lawyer to an opposing lawyer during a litigation or transaction between the clients of the lawyers, that might raise issues about preserving client confidentiality and trial/negotiation strategies that the former employing lawyer could raise but in your situation if the legal secretary was not an employee of the opposing lawyer during your litigation there is no such issue.

    Conflict of interest covers competing client interests not competing interests of one's current lawyer employer and one's former lawyer employer. In this situation, the legal secretary's actual knowledge about the opposing party being represented that arises from her having worked for the other attorney is the only relevant factor in determining whether there is a conflict of interest. If she has none then there is no conflict of interest so unless she switched employers during the litigation it's highly unlikely that there is any conflict of interest. Even if she did switch employers during the litigation, if she wasn't privy to any client information while she was working for the other lawyer, there is no conflict of interest.     This is a definite ';Conflict Of Interest';. This Legal Secretary should not be working on your case at all. This is not ethical. If the lawyer doesn't remove the Legal Secretary from working on your case, you should get another lawyer asap! I would get another lawyer anyway - you want an ethical lawyer so something doesn't come back later and bite you in the butt.

If custody is being reverted back to the 'custodial parent,' based on your question, that would be the natural parent or court appointed guardian. The court will usually give a set time and date to transfer the child/person to the person/s awarded custody. Failure to release/deliver the child/person can get you in serious trouble ... contempt of court charges and so on, even jail.

    It's hard to love a child born from an illegal and emotionally scarring sexual assault. Having your DNA mingled with the DNA of someone that would rape , you'd wonder what traits got passed on to the kid as well. Every time you'd look at the kid, you'd remember the assault. You'd end up resenting a child that did nothing bad to you and it's not fair to the child.





    In the case of incest, besides what I stated above, chances are that the child will be mentally or physically handicapped. If you were a woman raped by her father, would you want a mentally challenged reminder of the rape? Would you want your own father listed on the birth certificate of your child as the father of the child? Yeah, not likely.





    I do agree that in OTHER cases, it'd be a lot better to prevent the pregnancy. Contraceptives aren't 100% effective though.

    I fully agree with you about responsibility, but sometimes it is really in the kids best interest. Don't you know some people who really shouldn't be parents. While I don't agree absolutly with abortion just because it is more convienent, it really depends on the woman's situation, not just how the baby was conceived. What I think should happen is that the baby should be given up for adoption when born. But what happens if the mother doesn't take care of herself while pregnant? Should the baby be born with a crack addiction just because the mother is an asshole? And there's always the chance that instinct will kick in and the mother won't give the baby up, even though she is incapable of raising it properly. The baby shouldn't be punished for it's mother's stupidity, but that might mean never having to suffer for it to begin with

    my boyfriend is in jail for something he did not do but im sure thats a cliche saying. im saying that because they have no evidence at all against him and the witnesses the DA say they have has NEVERED showed up to court. what kind of penal code should be filed in order to win his freedom.Anyone with legal knowledge about criminal cases please help!!!!!!.?
    It's a little hard to understand your question. It looks like your boyfriend was arrested for the commission of a crime, and remanded to jail pending trial because he was unable to make bail and the crime was serious enough that he could not be released on his own recognizance.





    If he has a public defender appointed, his parents should be asking this person about helping him file a writ of habeas corpus Your boyfriend would have to show that there is a legal or factual error of the court that resulted in him being jailed pending trial. If he can show that the prosecutor's case isn't strong enough to warrant his pretrial detention, then he may be able to be released.

    Since he has already been arrested and thrown in jail, I would suggest hiring a lawyer to help you with this matter. You will need to look for a ';defense lawyer'; that practices in any type of criminal matters or wrongful arrests. There are a lot of details missing from your question, as to what has happened, therefore I can only recommend you find an attorney and give him the details of the case, to see what he can do for you.     He isn't in jail with no evidence against him. The fact that the witnesses have not showed up for court doesn't mean there is no evidence.





    He should have a lawyer helping him with his case. The lawyer will file any necessary and appropriate motions.
    He was arrested for something..however if the DA can't prove the crime beyond a reasonable doubt then he'll have to be released. His attorney should file I think they call it a motion to dismiss. If they have no evidence and no witnesses then they pretty much don't have a case. What is he in for??
