If possible, can you please provide me with around 5 dot points each? What are the Legal and Ethical issues of the Dr Haneef case?
Well, I am no legal eagle but it is not specifically Dr Haneef's case that is the problem, it is the Terrorism Laws themselves (or at least, the way they have been used).
These laws give all the power to the Police and the Government and leave the accused with no rights at all!
* assumed guilty until proved innocent. (and even then still to be vilified and suspected by 'face-saving' politicians)
* no right to swift justice (can be detained as long as they want or need to dig up some flimsy evidence)
* detained on suspicion alone without charge or evidence.
* have your name smeared in the media so that you are tried, sentenced and condemned before you have had a chance to defend yourself.
* In Australia, evidently, it is a crime to be related to someone who is suspected of being a criminal.
* Now, it is suspicious to buy a one way ticket to the country of your birth from Australia.
* Apparently, it is suspicious to want to leave Australia and go home to see your family, wife and new born baby as soon as you have been released from an ordeal of being accused and detained FOR NO REASON!What are the Legal and Ethical issues of the Dr Haneef case?
It's unethical that he was detained for twelve days without being charged with a crime.
